Terms of Service

ExodeK is currently in controlled alpha. These Terms describe the product as it operates today and the limited warranties that apply. They are a practical draft pending independent legal review before public commercial launch.

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you (“you”, “your”) and Vortix Pty Ltd (ABN 60 634 548 888) (“we”, “us”, “our”, “ExodeK”) for your use of the ExodeK service at https://exodek.app and related applications. By creating an ExodeK account or using ExodeK, you accept these Terms.

2. What ExodeK is

ExodeK is an AI-assisted email tool that connects to your Gmail account (with your authorisation), synchronises your messages, classifies them by urgency and category, identifies suggested actions, and helps you track action completion. ExodeK uses read-only Gmail access and does not send or modify email on your behalf.

ExodeK currently supports Gmail accounts only. Support for other email providers may be added in the future and these Terms will be updated accordingly.

ExodeK classifications and detected actions are produced by AI models and may be inaccurate, incomplete, or out of date. You must review them before acting on them. Do not rely on ExodeK as the sole source of truth for time-sensitive, legal, financial, medical, safety-critical, or other consequential decisions.

We do not warrant that any classification, urgency rating, category, recommended disposition, or detected action is accurate. You are responsible for reviewing the underlying email and forming your own judgement.

8. Email content — your responsibility

The email content displayed in ExodeK originates from your connected Gmail account. We do not generate, validate, or verify the truth of email content. You are responsible for the consequences of acting on any email content shown to you in ExodeK.

To the maximum extent permitted by law, ExodeK is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or freedom from defects or interruption. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, in no event shall Vortix Pty Ltd, its directors, employees, or contractors be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of ExodeK, including loss of profit, loss of data, loss of goodwill, or business interruption, whether based on contract, negligence, statute, or any other legal theory.

Our total aggregate liability arising out of or related to your use of ExodeK is limited, to the maximum extent permitted by law, to AUD $100.

12. Changes to these Terms

We may update these Terms from time to time. The current version is always available at https://exodek.app/terms. If we make material changes, we will notify you before they take effect. Continued use of ExodeK after a change takes effect constitutes your acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the exclusive jurisdiction of the courts of Queensland for any dispute arising out of or related to these Terms or ExodeK.
